Article 1 Purpose

The purpose of these terms and conditions is to stipulate rights, obligations and responsibilities of the website users who are provided the internet-related services (hereinafter referred to as “service”) through the online internet website (hereinafter referred to as “website”) run by GOLDEN TULIP Incheon Airport Hotel & Suites (hereinafter referred to as “company”).

Article 2 Definitions

1. Website” refers to a virtual place of business set up by the company to provide goods or services (hereinafter referred to as “goods, etc.”) to users using information and communication facilities such as computers to transact goods, etc. and is also used in the sense of a business operator operating the website.
2. “User” refers to both member and non-member of the Website who obtains services in accordance with these terms and conditions by accessing this website.
3. “Posts” refer to any type of informational contents including writings, photos, videos, and other files and URLs in the form of signs, characters, voice, sound, pictures and video uploaded in response to the services provided by the company.

Article 3 Provision of Service

1. The website performs the following tasks.

1. 1-1. Provision of information on goods or services, benefits, etc.
2. 1-2. Events, promotions and other customized services for members
3. 1-3. Services either developed by the company or provided by the company in partnership with other businesses.
4. 1-4. Verification and confirmation of goods or services for which the purchase contract was concluded
5. 1-5. Other services provided by the website

2. The website operates 24/7 unless there is any technical or work disruption. However, on the specified dates set out by the website for a regular maintenance, there may be a halt in website operations.

Article 4 Application of T&C

1. Accommodation contracts and related contracts concluded by the hotel shall be governed by the provisions of this Agreement, and matters not stipulated in this Agreement shall be governed by law or custom.

2. The hotel shall comply with this regulation regarding credit card bookings, but the details shall be in accordance with the terms and conditions between the credit card company and the hotel merchant.

3. The hotel may comply with the special agreement within the scope of its intent, statute or custom, without prejudice to the provisions of the preceding paragraph.

Article 5 Payment Method

1. Payment of goods or services purchased from the website can be made by any of the following methods. However, the website cannot collect by adding any commission for the payment of goods or alike in respect to the payment method of the user.

1. 1-1. Various account transfers such as phone banking, internet banking, e-banking etc.
2. 1-2. Prepaid card, debit card, credit card, etc.
3. 1-3. Online deposit & payment by other electronic payment methods provided through PG etc.

2. Accommodation charges will also be charged if the customer has started using the room and has not stayed at the same date.

3. All room rates are based on the number of rooms and may be subject to additional charges if additional guests are added.

Article 6 Refusal of Accommodation

The hotel reserves right to refuse the guests for staying if:

1. 1. If an application for accommodation is not under this contract
2. 2. In case of the room is not available due to fully booked situation.
3. 3. If the customer who intends to stay is considered to be in violation of laws and ordinances concerning accommodation or acts contrary to public order or morals.
4. 4. If the customer is clearly identified as an infectious disease
5. 5. In case of an unnecessary compensation is requested for accommodation
6. 6. If a person is recognized to have pets, dangerous drugs, explosives, or weapons
7. 7. In case of natural disasters, facility failures, and other unavoidable reasons for not being able to accommodate the accommodation
8. 8. Where it is deemed impossible to stay as prescribed by the laws and regulations of the Republic of Korea

Article 7 Registration of Accommodation

Guests are requested to register the following at the hotel's front desk on the day of stay:

1. 1. Guests name, gender, date of birth and contact number
2. 2. Passport number and visa type for foreigners, date of arrival in Korea
3. 3. Other information deemed necessary by the hotel

Article 8 Check in Time Check out Time

1. Check in Time is 3 pm.

2. Check Out Time is 12 noon

3. If a guest wishes to extend Check Out Time, 11,000 Korean won per hour will be charged accordingly.

4. If a guest wishes to check out after 4 pm, full day charge will be applied.

Article 9 Refund & Cancellation Policy

1. In case of NO SHOW, a one-night fee will be charged for the reservation guaranteed.

2. Cancellations and changes can be made up to 3 days before arrival (72 hours).

3. Cancellations for the day will be charged 100% for one night.

Article 10 Liabilities [Hotel]

1. Hotel cannot share or distribute the personal information the user has provided to Hotel in order to receive services without the user’s express consent, except in the following circumstances:

1. 1-1. As requested from a Korean government agency according to Korean law.
2. 1-2. Intended criminal activity on behalf of the user or at the request of the telecommunication committee.
3. 1-3. At the request of other legal proceedings.

2. In relation to 1 above, hotel reserves the right to use all or part of the user’s information to determine statistical information related to reservation and the right to place cookies on the user’s computer. The user has the right to refuse cookies or adjust the cookie warning system on their browser’s setting

Article 11 Liabilities [Guest]

1. The user agrees not to engage in any of the following activities;

1. 1-1. Use another user’s information inappropriately.
2. 1-2. Provide to others, reproduce or distribute through broadcast or in print information obtained from services offered to a user without the hotel’s prior authorization.
3. 1-3. Infringe hotel’s intellectual property rights or the property rights of others participating in the site
4. 1-4. Providing information, sentences or any kind of figure that could be an offense against public moral or public act.
5. 1-5. Engage in any behavior which an objective person would determine to be criminal or otherwise improper
6. 1-6. Other illegal behavior.

2. The user agrees to abide by the law, by the rules and regulations of the user guidelines, of the service usage information and all updates thereof.

3. The user agrees to follow all of the public notifications and/or publicly announced usage restrictions that hotel may issue.

4. The user cannot use the services engage in any profitable actions without the express prior consent of hotel.

5. GOLDEN TULIP Incheon Airport Hotel & Suites is non-smoking premise, smoking is prohibited in the guest room as well as indoor public area by law.

Article 12 Responsibilities of Accommodation

1. Hotel accommodation responsibilities shall be held from the time the guest registered at the hotel's front desk or the guest was informed of the room, and the responsibility shall be completed if the guest has checked out and left the room.

2. The hotel does not take any responsibility for any accidents that are expected, as the hotel does not comply with the rules of use given by the hotel.

3. If the hotel can not provide the guest with a room after the reservation guaranteed, the hotel will arrange the same or better accommodation and compensate 100% of the first day's accommodation.

Article 13 Exemption clause

1. Hotel is freed from any responsibility in the event of service limitation or discontinuance caused by war, environmental disaster or other national emergency.

2. Hotel is not responsible in problems with service provision caused by the user.

3. Hotel is not responsible for any loss experienced (or profit sought but not attained) by the user from services offered by hotel.

4. Hotel is not responsible for the information or other materials and the accuracy and truthfulness thereof published by the user through hotel’s services.

Article 14 Resolution of Dispute

1. Users should not use the information acquired from the website, which the website holds copyrights to for the purpose of making profits by copying, transmitting, publishing, distributing, broadcasting, etc. or allowing a third party to use the information without permission.

2. If the website uses copyrights vested in a user pursuant to the terms and conditions, the website should notify the user on such matters.

Article 15 Jurisdiction & Governing Law

1. Lawsuits concerning e-commerce disputes between the website and users shall be based on the address of the user at the time of filing, and if there is no address, it will be under the exclusive jurisdiction of the district court having jurisdiction over the residence. However, if the address or residence of the user is not clear at the time of filing, or if the user is residing in foreign country, submit it to the court having jurisdiction under the Code of Civil Procedure.

2. The governing law of this terms and conditions is Korean law.

(Effective Date) These Terms and Conditions shall be effective from Sep 01, 2024.
